| 通过分析俄罗斯花样滑冰运动员瓦利耶娃兴奋剂违规案件的仲裁过程和结果,探讨该案件反映出的法律争议及其对完善反兴奋剂规则的启示。梳理了本案的基本案情与裁决结果,并结合瓦利耶娃的 “受保护人员”身份,分析了反兴奋剂规则中实验室检测程序、举证责任分配和处罚标准适用中存在的问题。认为,仲裁庭在未充分考虑运动员权益的情况下对未成年人施以过于严苛的处罚,有悖比例原则与公平原则。建议强化实验室监管责任,完善受保护人员条款落实路径,明确兴奋剂违规处罚标准,推动仲裁裁决的一致性与公正性,最终实现对运动员权益的更好保护。 |

| Analysis of the Doping Violation Case of Kamila Valieva |

| Abstract: |
| By analyzing the arbitration process and results of the doping violation case of Russian figureskater Kamila Valieva, this paper discusses the legal disputes reflected in the case and its enlightenmentto improve the anti-doping rules. This paper sorts out the basic facts and ruling results of thecase, and analyzes the problems existing in the application of laboratory testing procedures, distributionof burden of proof and punishment standards in the anti-doping rules in combination with KamilaValieva’s status as a “Protected Person”. It is believed that the arbitral tribunal imposes too harshpunishment on minors without fully considering the rights and interests of athletes, which is contraryto the principle of proportionality and fairness. It is suggested to strengthen the supervision responsibilityof laboratories, improve the implementation path of “Protected Persons” provisions, clarify thepunishment standards for doping violations, promote the consistency and fairness of arbitration awards,and finally achieve better protection of athletes’ rights and interests. |
