| 正当的兴奋剂检查程序对于保障运动员的身心健康与体育赛事公平具有重要意义。尽管 2021版 《世界反兴奋剂条例》及其下的 《检查与调查国际标准》对检查程序进行了规范,但既有检查程序仍存在检查措施的类型未区分、检查对象的范围过于宽泛、检查程序启动的决定主体中立性不足、违规检查所应承担的法律后果不清晰以及运动员相关权利缺乏保障等突出问题。因此,有必要以比例原则和程序正当原则为指导进行完善。未来,应当通过建立兴奋剂检查审批制度、按照一定的标准缩小检查对象的范围以及设置两阶层的运动员权利救济体系,弥补既有检查程序的不足。这些制度的完善对于解决我国兴奋剂检查程序中的问题具有参考价值。 |

| Properdopinginspectionproceduresareofgreatsignificancetoensurethephysicaland mentalhealthofathletesandthefairnessofsportsevents.Althoughthe WorldAnti-DopingCode (WADC2021)andtheInternationalStandardforTestingandInvestigations(ISTI2021)haveregulatedtheinspectionprocedures,therearestillsomeoutstandingproblemsintheexistinginspectionprocedures,suchasthetypesofinspectionmeasuresarenotdistinguished,thescopeofinspectionobjectsistoobroad,theneutralityofthedecision-makingbodyinitiatedbytheinspectionproceduresis insufficient,thelegalconsequencesofviolationinspectionsarenotclear,andtherightsofathletesare notguaranteed.Therefore,itisnecessarytobeguidedbytheprincipleofproportionalityandthe principleofdueprocess.Inthefuture,weshouldmakeupfortheshortcomingsoftheexistinginspectionproceduresbyestablishingadopinginspectionandapprovalsystem,narrowingthescopeof inspectionobjectsaccordingtocertainstandards,andsettingupatwo-levelathleterightsreliefsystem.TheimprovementofthesesystemshasreferencevalueforsolvingtheproblemsinChina’sdopinginspectionprocedures |
